The President banned the confiscation of equipment used in the illegal felling of forest

Vladimir Putin signed the Federal law "On amendments to articles 3.7 and 8.28 of the Code of the Russian Federation on administrative violations", the official website of the President. The document was passed by the Parliament on 18 December 2012 and 26 December, approved by the Federation Council.

The Federal law is approved in order to implement the decisions of the constitutional court of the Russian Federation about a recognition illegal confiscation of equipment from owners who have not been brought to administrative responsibility for illegal felling of timber, and not found guilty of this offence.

According to the state-legal administration, article 3.7 "confiscation of the instrument of committing, or the subject of an administrative offence" amended, do not permit withdrawal of instrument of committing an administrative offence from the owner, which is not subject to the offence. Appropriate modifications to the sanctions of article 8.28 "Illegal cutting and damage of forest plantings or autocratic excavation in woods of trees, shrubs, vines", which were the subject of consideration in the constitutional court and was the basis for the issuance of the said decision.
